What state law says
RCW 9.46.0237 — part of Washington’s Gambling Act (RCW Chapter 9.46) — makes transmitting or receiving gambling information by wire, cable, radio, or other means a Class C felony, punishable by up to 5 years in prison and a $10,000 fine. Washington’s online gambling prohibition is one of the strongest in the country and was enacted long before the sweepstakes casino model existed.
Washington State has a large tribal gaming market (29 tribal casinos) and a state lottery, but does not have commercial casinos or licensed online casino gaming. The Washington State Gambling Commission has historically taken an aggressive posture against online gambling services, including taking action against online poker sites when they operated in Washington.
The AMOE (Alternate Method of Entry) defense that sweepstakes platforms rely on in other states has not been tested against Washington’s specific “transmitting gambling information” prohibition. The breadth of RCW 9.46.0237 extends to the act of transmitting gaming content — not just receiving wagers — which creates risk even for platforms claiming no consideration is required.
Recent developments
No sweepstakes-casino-specific legislation has been introduced in the Washington Legislature as of June 2026 — because existing law is broadly read to cover the conduct. The Washington State Gambling Commission has not issued mass C&D letters specifically to sweepstakes casino operators, but platforms have self-excluded from Washington in recognition of the existing legal risk.
