What state law says

Oregon gambling law is codified at ORS Chapter 167. Oregon uniquely has a state-operated video lottery (video poker and slots) distributed through licensed retailers — a model operated exclusively by the Oregon Lottery. Oregon also has tribal gaming under IGRA compacts and legalized sports betting (launched 2019 via the Oregon Lottery’s Scoreboard app).

Oregon does not have a commercial gaming regulatory agency separate from the Oregon Lottery. The Oregon Lottery has a state monopoly on certain gambling forms, which creates a different regulatory context than states with commercial casino control boards. However, the Oregon Lottery has not issued guidance treating online sweepstakes platforms as unlicensed competition under state law.

ORS § 167.117 defines gambling; sweepstakes operators argue the AMOE free-entry alternative removes the consideration element required by that definition.

Recent developments

No legislation targeting dual-currency sweepstakes casinos has been introduced in the Oregon Legislative Assembly as of June 2026. The Oregon Lottery and Oregon Attorney General’s office have not issued guidance or enforcement actions against sweepstakes casino operators.
