What state law says
South Dakota gambling law is governed by the South Dakota Commission on Gaming. South Dakota’s constitution was amended to permit limited gaming in the historic district of Deadwood, resulting in a concentrated commercial casino market there. The state also has tribal gaming under IGRA compacts and a state lottery. Sports betting launched in South Dakota in 2022 following a 2020 constitutional amendment.
SDCL § 22-25A-1 governs unlawful gambling. The South Dakota Commission on Gaming has not issued guidance or enforcement actions specifically targeting dual-currency sweepstakes platforms. Sweepstakes operators argue their AMOE free-entry alternative removes the consideration element under South Dakota law.
