What state law says
North Dakota gambling law is codified at N.D. Cent. Code § 12.1-28-01 et seq. North Dakota has charitable gaming (pull tabs, bingo, poker) and horse racing, but no commercial casinos. North Dakota does not have tribal casinos operating under IGRA (federally recognized tribes in the state operate gaming under separate authority). The state does not have a lottery.
North Dakota does not have a state gaming commission with jurisdiction over online gaming. The absence of a commercial gaming regulatory body and the state’s relatively limited gaming market means there is no agency positioned to issue the kind of enforcement actions seen in Michigan or Illinois. Sweepstakes casino operators have not been challenged by any North Dakota authority.
Recent developments
No legislation targeting dual-currency sweepstakes casinos has been introduced in the North Dakota Legislative Assembly as of June 2026. The state’s Attorney General has not issued guidance on the sweepstakes casino model.
