What state law says
Ohio gambling law is codified in Ohio Revised Code Chapter 2915. Section 2915.01 defines “gambling” as risking something of value on the outcome of a game of chance or event — requiring all three elements: something of value risked, chance, and a prize.
Sweepstakes casino operators argue that obtaining Sweeps Coins (the redeemable currency) through the free alternate method of entry removes the “something of value risked” element, keeping the model outside ORC § 2915.02’s prohibition on operating an illegal gambling enterprise.
Ohio’s gambling regulator is the Ohio Casino Control Commission, which oversees the state’s four licensed casinos and seven racinos. The Commission has not issued guidance specifically addressing the sweepstakes casino model, and no cease-and-desist has been issued to any platform.
Recent developments
2025 legislative session — House Bill 298 and Senate Bill 197 were introduced to legalize full online casino gaming in Ohio. Neither advanced significantly. These bills are about expanding licensed online gambling — not restricting sweepstakes casinos — but passage could create pressure on the unlicensed model.
No enforcement: The Ohio Casino Control Commission has not issued cease-and-desist letters or formal opinions targeting sweepstakes casino operators as of June 2026.
