What state law says
Illinois gambling law is governed by the Illinois Gambling Act (230 ILCS 10), administered by the Illinois Gaming Board (IGB). The Act requires a license for any entity that “conducts, operates, controls, or manages” a gambling operation.
The IGB’s position, stated in its February 2026 enforcement action, is that dual-currency sweepstakes casino platforms conduct unlicensed gambling operations under Illinois law. The IGB argues that offering cash-redeemable prizes through casino-style games constitutes gambling regardless of whether the sweepstakes promotional defense applies, because Illinois law focuses on the nature of the activity rather than the payment mechanism.
No Illinois court has ruled on whether the sweepstakes AMOE defense defeats the IGB’s position.
Recent developments
February 4, 2026 — The Illinois Gaming Board, alongside Attorney General Kwame Raoul, issued cease-and-desist letters to 65 sweepstakes casino operators. Stake.us and McLuck were among those named. The IGB’s position: all named platforms were operating unlicensed online casinos in Illinois.
February–May 2026 — 63 of the 65 operators who received C&D letters continued to serve Illinois players without compliance. Stake.us was one of only two operators that chose to comply.
May 19, 2026 — Stake.us placed all Illinois accounts in “redeem-only mode” and then exited. The exit was announced in advance and Illinois players were given time to redeem remaining Sweeps Coins.
June 2026 — McLuck appears to still be serving Illinois players despite receiving the C&D. SpinQuest was not among the initial 65 recipients and continues to accept Illinois players. The IGB has not yet escalated enforcement beyond the initial C&D wave.
Why platform availability differs
Stake.us chose compliance; McLuck and most other operators chose to wait. The C&D letters are a regulatory warning, not a court order — operators that ignore them face potential escalation (fines, lawsuits, referral to the AG for prosecution), but there has been no immediate consequence for non-compliance as of June 2026.
