What state law says
North Carolina’s gambling prohibition is codified at N.C. Gen. Stat. § 14-292, which makes it a Class 2 misdemeanor to play or bet for money or other property at any game. The statute applies to persons who gamble, not operators specifically.
North Carolina has a notable history with sweepstakes machines. In 2010, the state enacted legislation (later amended) targeting physical sweepstakes cafés, internet-café operations where players purchased internet time and received sweepstakes entries. Those physical establishments were effectively banned. However, online sweepstakes casinos with a genuine free alternate method of entry operate on a different legal footing than the internet café model.
The state has no gaming commission that oversees commercial gambling broadly; oversight of the Eastern Band of Cherokee Indians’ tribal casino falls under the Tribal-State compact. There is no state agency with a clear mandate to regulate online sweepstakes platforms.
Recent developments
2025–2026 session: HB 489 was introduced, proposing a comprehensive regulatory framework for sweepstakes and promotional games in North Carolina. The bill would establish licensing requirements and operational standards. As of June 2026, it has not advanced to a floor vote. If passed, it could bring clarity, but also restrict, the sweepstakes casino model.
No enforcement action has been filed by the North Carolina Attorney General’s office against any sweepstakes casino platform.
