What state law says
Georgia gambling law is codified at O.C.G.A. § 16-12-20, which defines gambling as making a bet on a game of chance or skill, or operating a gambling device. Section 16-12-28 prohibits gambling devices.
Georgia is one of the few states with no legal commercial casinos, no legal sports betting, and no legal poker rooms. The state permits a lottery and certain charitable gaming. This conservative overall gambling posture influences how regulators and prosecutors may view unlicensed sweepstakes platforms, even if no formal action has been taken.
The sweepstakes casino operators’ no-purchase-necessary defense has not been adjudicated in Georgia courts. Georgia does not have a state gaming commission with regulatory authority over commercial gambling outside the lottery.
Recent developments
2025–2026 session — SB 385 was introduced, proposing restrictions on sweepstakes operations that use electronic devices resembling slot machines. The bill focuses primarily on physical sweepstakes machines (a different category than online platforms) but could be interpreted broadly. As of June 2026, SB 385 has not advanced to a floor vote.
No enforcement action has been filed by the Georgia Attorney General’s office against online sweepstakes casino platforms.
Why McLuck is unavailable
McLuck exited Georgia proactively, citing the state’s conservative gambling posture and regulatory risk — not a specific enforcement action or legislation. McLuck’s operator (B-Two Operations Limited) made a business decision to avoid operating in a state with an aggressive anti-gambling posture, even without a formal legal challenge. Stake.us and SpinQuest have taken a different risk assessment and continue to accept Georgia players.
