What state law says
New Mexico gambling is regulated by the New Mexico Gaming Control Board. The state has extensive tribal gaming under compacts with 23 tribal nations, as well as horse racing with electronic gaming machines at racetracks. New Mexico does not have commercial casinos, and the state legislature has repeatedly declined to authorize them.
New Mexico law (NMSA 1978 § 30-19-1 et seq.) defines gambling broadly as risking money or other items of value on games of chance or skill. The New Mexico Gaming Control Board has not issued guidance or enforcement actions targeting dual-currency sweepstakes casino platforms. Sweepstakes operators rely on the AMOE (Alternate Method of Entry) free-play alternative to argue their platforms do not constitute gambling under New Mexico law.
Recent developments
No legislation targeting dual-currency sweepstakes casinos has been introduced in the New Mexico Legislature as of June 2026. The New Mexico Gaming Control Board has not announced enforcement intentions against sweepstakes platforms.
