What state law says
Colorado gambling law is codified at C.R.S. § 18-10-101 et seq. The state has a licensed casino market in three mountain towns (Black Hawk, Cripple Creek, and Central City) and legalized sports betting in 2020 under Proposition DD. Online casino gaming beyond sports betting is not yet legalized.
The Colorado Limited Gaming Control Commission oversees licensed casinos. Colorado has not issued guidance on the sweepstakes casino model, and the Commission has not indicated intent to pursue enforcement against unlicensed sweepstakes platforms. The state’s licensed gambling market is geographically constrained to those three towns, which may reduce competitive pressure on regulators compared to states with broader licensed online casino markets (like Pennsylvania or New Jersey).
Sweepstakes casino operators argue their no-purchase-necessary model falls outside the gambling prohibition in § 18-10-103.
Recent developments
No legislation specifically targeting dual-currency sweepstakes casinos has been introduced in the Colorado General Assembly as of June 2026. No enforcement actions have been filed against any sweepstakes platform by the Colorado Limited Gaming Control Commission or the Attorney General’s office.
