What state law says
Massachusetts gambling law is administered by the Massachusetts Gaming Commission (MGC), established by the 2011 Expanded Gaming Act (M.G.L. c. 23K). The state has three licensed resort casinos (MGM Springfield, Encore Boston Harbor, Plainridge Park) and a state lottery.
Massachusetts general gambling law does not include a sweepstakes-specific exemption statute, but the state has not adopted regulatory guidance treating dual-currency sweepstakes platforms as illegal online gambling. Sweepstakes casino operators argue their no-purchase-necessary, free-entry alternative method removes the consideration element required for an illegal lottery or gambling operation under Massachusetts law.
The Massachusetts Gaming Commission’s mandate focuses on licensed gaming facilities; the agency has not publicly announced an intent to regulate or pursue online sweepstakes operators.
