What state law says
Kansas gambling law is codified at K.S.A. § 21-6403, which defines gambling as making a bet. Kansas has a state lottery and four state-owned casinos (managed by private operators under management contracts). Sports betting launched in Kansas in 2022.
The Kansas Racing and Gaming Commission oversees licensed gambling. It has not issued guidance specifically addressing online sweepstakes platforms, and no cease-and-desist orders have been issued to sweepstakes casino operators. Sweepstakes casino operators argue their no-purchase-necessary model removes the “bet” element required under Kansas law.
Recent developments
No legislation specifically targeting dual-currency sweepstakes casinos has been introduced in the Kansas Legislature as of June 2026. No enforcement actions have been filed by the Kansas Attorney General’s office or the Kansas Racing and Gaming Commission.
