All three major sweepstakes platforms — Stake.us, McLuck, and SpinQuest — block Idaho players. Idaho’s constitution prohibits lotteries, and the state’s broad anti-gambling stance has led all three platforms to exclude Idaho as a pre-existing policy. No new legislation or enforcement action drove these exclusions.

What state law says
Idaho’s anti-gambling framework is rooted in the Idaho Constitution, Article III, § 20, which prohibits lotteries. Idaho Code § 18-3801 defines gambling broadly and prohibits it. Idaho’s interpretation of its constitution and gambling statutes is among the most restrictive in the United States: the state does not permit commercial casinos, video poker machines, or most prize-based promotions involving chance.
Notably, Idaho’s constitution defines a “lottery” broadly enough to encompass many promotional sweepstakes. This is why all three platforms have maintained pre-existing exclusions for Idaho — not because of a new law targeting sweepstakes casinos specifically, but because Idaho’s foundational legal framework makes the sweepstakes casino model legally untenable under any reading of state law.
Idaho does permit tribal gaming under federal Indian Gaming Regulatory Act compacts, but commercial sweepstakes operations fall outside that framework.
Recent developments
Idaho’s exclusion by all three platforms predates the 2024–2026 wave of state sweepstakes casino bans. No new legislation specifically targeting the dual-currency model has been introduced, but none is needed — the existing constitutional and statutory framework already leads operators to exclude Idaho as a compliance matter.
No enforcement actions against sweepstakes platforms have been publicly identified in Idaho, consistent with a pattern where platform self-exclusion removes the need for regulator action.
