What state law says
West Virginia was among the earliest states to legalize online casino gaming, passing the West Virginia Lottery Interactive Wagering Act in 2019. Licensed online casino operators include BetMGM, DraftKings, FanDuel, and Caesars — all anchored to West Virginia’s five land-based casinos.
West Virginia Code § 61-10-1 et seq. addresses illegal gambling. The West Virginia Lottery administers both the state lottery and licensed iGaming. The Lottery’s position is that online platforms offering casino-style games with redeemable prize currency must hold a West Virginia iGaming license. Unlicensed sweepstakes platforms have not obtained such licenses.
The pattern in West Virginia mirrors that seen in Michigan and New Jersey: states with licensed online gambling markets tend to treat unlicensed sweepstakes platforms as illegal competitors. Stake.us and McLuck have self-excluded from WV in response to this regulatory posture.
Recent developments
No sweepstakes-casino-specific legislation has been enacted in the West Virginia Legislature as of June 2026. The West Virginia Lottery’s enforcement approach has relied on existing authority under the iGaming licensing statute rather than a new ban statute.
SpinQuest’s continued presence in West Virginia reflects a different operator-level compliance assessment — either that SpinQuest’s specific model falls outside the WV Lottery’s enforcement priority, or that SpinQuest’s legal team has reached a different conclusion about WV law.
