What state law says

Texas gambling law is codified in Texas Penal Code Chapter 47. Section 47.02 defines illegal gambling as placing a bet on a game of chance or skill for money — and requires all three elements: consideration, chance, and prize.

Sweepstakes casino operators argue their model removes the consideration element: because Sweeps Coins (the redeemable currency) can be obtained without any purchase via a free alternate entry method, no money is required to play for prizes. Without consideration, the legal definition of gambling is not met.

Texas Business and Commerce Code Chapters 621 and 622 govern promotional sweepstakes and mail-conducted contests. These provisions apply to sweepstakes generally, but do not target or restrict the dual-currency online model specifically.

Texas has no gaming commission with broad authority over non-lottery gambling. The Texas Lottery Commission oversees the state lottery; there is no state agency with a clear mandate to regulate or prohibit sweepstakes casinos.

Recent developments
