What state law says

New Jersey launched the first legal online casino market in the US outside Nevada in 2013 under the New Jersey Internet Gaming Enabling Act. Today, New Jersey has one of the largest legal online gambling markets in the country, with dozens of licensed online casinos and poker sites anchored to the Atlantic City casino market.

The New Jersey Division of Gaming Enforcement (DGE) has jurisdiction over all gaming in New Jersey, including online operations. The DGE’s position is that online platforms offering casino-style games with cash-redeemable prize systems must hold a New Jersey gaming license. Sweepstakes platforms have not obtained NJ iGaming licenses, making their operations — by the DGE’s assessment — unlicensed online gaming.

New Jersey’s situation is similar to Michigan and Nevada: a state with a large, licensed online gambling market that treats unlicensed sweepstakes platforms as illegal competitors rather than a legal gray zone.

Recent developments

A5447 has advanced in the New Jersey Legislature. The bill would provide an explicit statutory framework addressing dual-currency sweepstakes platforms — either banning them outright or establishing a regulatory pathway. As of June 2026, A5447 has not been signed into law. Its progress reflects ongoing legislative attention to the sweepstakes casino category in New Jersey.

New Jersey’s licensed casino operators, including Caesars, DraftKings, FanDuel, and BetMGM, have financial interests in limiting unlicensed competition. The DGE has continued enforcement without waiting for A5447 to pass.
