What state law says
Kentucky gambling law is codified at KRS § 528.010, which defines gambling as staking or risking something of value upon the outcome of a contest of chance or future contingent event. Kentucky does not have a specific sweepstakes exemption statute comparable to Florida’s § 849.094, and the state’s prize contest law creates uncertainty around cash-redeemable sweepstakes models.
Kentucky has a state lottery and legal horse racing (including historical horse racing machines). The state legalized sports betting in 2023. However, no Kentucky regulatory agency has issued formal guidance on dual-currency sweepstakes casino platforms, and there has been no formal enforcement action against any operator.
The split between platforms — Stake.us and McLuck excluding Kentucky while SpinQuest does not — reflects different operator-level compliance assessments of the same legal framework, not a definitive legal ruling.
