What state law says
Hawaii and Utah are the only two states in the US with no legal gambling of any kind — no lottery, no tribal casinos, no charitable gaming, no sports betting. Hawaii Revised Statutes § 712-1220 to § 712-1224 define and prohibit gambling, including operating a gambling place and possessing gambling devices.
Despite this environment, all three sweepstakes platforms serve Hawaii. The reason: sweepstakes casino operators argue their model is a promotional activity, not gambling — because no purchase is required to receive Sweeps Coins and play for prizes. The AMOE (alternate method of entry) defense removes the “consideration” element that triggers Hawaii’s gambling prohibition.
Hawaii has no gaming commission or gambling regulatory agency. There is no state body with a mandate to actively monitor or enforce against online sweepstakes platforms. This enforcement gap means that despite a stricter-than-average anti-gambling stance in statute, there is no regulator positioned to take action.
