What state law says
Delaware’s gambling framework is anchored by the Delaware Gaming Competitiveness Act of 2012, which authorized a fully licensed online casino market operated through the Delaware State Lottery. Licensed online casinos (slots, poker, table games) are legal and regulated for Delaware residents.
The Delaware Division of Gaming Enforcement (DGE) takes the position that unlicensed sweepstakes platforms violate the Delaware Constitution and the Delaware Penal Code by operating illegal online gambling — regardless of whether those platforms use the sweepstakes/no-purchase-necessary model. The DGE’s view: if it looks like a casino and plays like a casino, it requires a Delaware license.
Recent developments
April 2, 2025 — The Delaware Division of Gaming Enforcement issued a cease-and-desist order to VGW Luckyland, finding that VGW was operating illegal online slots by misrepresenting its services as promotional sweepstakes. The DGE stated the platform violated the Delaware Constitution, the Delaware Penal Code, and the Delaware Gaming Competitiveness Act of 2012.
2025 — Following the VGW action and broader enforcement signals, more than 30 sweepstakes casino platforms exited Delaware. Stake.us left in February 2025 as part of a multi-state exit from regulated iGaming markets. McLuck followed suit.
June 2026 — SpinQuest continues to accept Delaware players. SpinQuest was not named in the VGW enforcement action, and its operator has made a different compliance determination. Players should verify SpinQuest’s current eligibility terms before playing, as the DGE’s enforcement posture suggests continued risk.
Why most platforms are unavailable
Delaware is one of the few states where the regulatory argument for enforcement is clearest: Delaware has a licensed online casino market, meaning the state has affirmatively decided how online casino-style games should be regulated. Unlicensed platforms that operate in that space face a well-defined legal argument that they are competing illegally. Stake.us and McLuck chose to exit; SpinQuest remains at its own risk determination.
