What state law says
Arkansas gambling law is governed by Ark. Code Ann. § 5-66-104, which prohibits gambling generally. However, Arkansas voters approved Issue 4 (Constitutional Amendment 100) in November 2018, expanding legal gambling to include four commercial casino licenses in the state.
The state’s gambling authority — the Arkansas Racing Commission (which oversees casino gaming under the 2018 amendment) — has not issued guidance specifically addressing online sweepstakes platforms. Sweepstakes casino operators argue their no-purchase-necessary model falls outside the gambling prohibition because it eliminates the “consideration” element required for illegal gambling.
