What state law says
Arkansas gambling law is governed by Ark. Code Ann. § 5-66-104, which prohibits gambling generally. However, Arkansas voters approved Issue 4 (Constitutional Amendment 100) in November 2018, expanding legal gambling to include four commercial casino licenses in the state.
The state’s gambling authority, the Arkansas Racing Commission (which oversees casino gaming under the 2018 amendment), has not issued guidance specifically addressing online sweepstakes platforms. Sweepstakes casino operators argue their no-purchase-necessary model falls outside the gambling prohibition because it eliminates the “consideration” element required for illegal gambling.
